Özet
ÖZET
İşverenle
işçi arasındaki icare akdinde, ücretin işin neticesinde ortaya çıkan üründen
verilmesinin şart koşulması caiz görülmemektedir. Bu nedenle ağaçtaki meyveleri
toplatmak için işçi kiralayıp, ücreti toplanacak meyvelerden ödemeyi şart
koşmak caiz değildir. Bu gibi durumlarda ya ücretin başka bir bahçenin ürünü
olarak ya da mutlak olarak belirlenmesi gerekmektedir. Çünkü hadislerde,
değirmenciyle yapılan anlaşmada ücretin elde edilecek undan verilmesinin şart
koşulması (kafizü’t-tahhân) yasaklanmıştır. Bu hadisler, diğer taraftan,
değirmencinin buğdaylara ortak olması halinde, onları öğütmesi karşılığında
ücret talep etmesinin caiz olmadığına işaret etmektedir. Dolayısıyla bahçenin
ortaklarından birinin ağaçtaki meyveleri toplama karşılığında ücret talep
etmesi caiz değildir. Bu gibi durumlarda, ilk durumdan farklı olarak, ücretin
toplanacak meyvelerden ya da başka bir şeyden belirlenmesi arasında fark
yoktur. Çünkü birinci meselede sorun, ücretin toplanacak meyvelerden
belirlenmesi iken, ikinci meselede sorun, rakabesine ortak olunan bahçede
çalışma karşılığında ücret talep edilmesidir. Birinci meseleyle ikinci mesele
arasındaki diğer fark, her iki akdin de fasid olmasına rağmen, birincide ecr-i
misilin tahakkuk etmesi, diğerinde etmemesidir. Yani yukarıda anlatılan
akitlerde, ortak olmayan işçinin emeğine karşılık ecr-i misil ödemek
gerekirken, ortak olan işçinin emeğine karşılık ecri misil ödemek
gerekmemektedir. Bunun sebebi, ilkinde sözün yerine getirildiğini söyleme
imkanının bulunması, ikincisinde sözün yerine getirildiğini söyleme imkanının
bulunmamasıdır. Çünkü bir kimsenin aynı anda hem kendisi hem de başkası için iş
görmesi düşünülemez. Bahçede iş yaptırmanın icare akdi dışında başka bir yolu
daha bulunmaktadır. Müsakat adı verilen bu akit, ürünü paylaşma esasına dayanan
bağ-bahçe ortakçılığı anlamına gelmektedir. Bahçe sahibiyle işletmeci/ler
arasında kurulan müsakat akdinin sahih olabilmesi için işletmecinin bahçenin
rakabesinde ortaklığının olmaması gerekmektedir. Fasid müsakat akdinde tıpkı fasid
icare akdinde olduğu gibi ortağın emeğine karşılık ecr-i misil ödemek
gerekmemektedir.

ABSTRACT
In
the contract of employment between the employer and the employee, it is not
considered permissible to stipulate that the wage should be paid from the
product resulting from the work. For this reason, it is not permissible to hire
workers to collect the fruits from the tree and require payment from the fruits
to be collected. In such cases, the fee must be determined either as the
product of another garden or as an absolute. Because it is prohibited in the
hadiths to stipulate that the wage should be paid from the flour to be obtained
in the agreement made with the miller (kafiz al-tahhan). These hadiths, on the
other hand, indicate that if the miller shares the wheat, it is not permissible
for him to demand a fee for grinding it. Therefore, it is not permissible for
one of the partners of the garden to demand a fee for picking the fruits from
the tree. In such cases, unlike the first case, there is no difference whether
the fee is determined from the fruits to be collected or from something else.
Because, in the first issue, the problem is determining the wage from the
fruits to be collected, while in the second issue, the problem is demanding a
fee for working in the shared garden. Another difference between the first
issue and the second issue is that although both contracts are fasid, an
equivalent fee accrues in the first one, but not in the other. In other words,
in the contracts described above, while it is necessary to pay an equivalent
wage for the labor of a non-partner worker, it is not necessary to pay for the
labor of a partner worker. The reason for this is that in the first case it is
possible to say that the promise has been fulfilled, in the second case it is
not possible to say that the promise has been fulfilled. Because it is
unthinkable for a person to work for himself and others at the same time. There
is another way to get work done in the garden other than a lease a person. This
contract, called Musakat, means vineyard-orchard sharecropping based on the
principle of sharing the product. In order for the musakat contract established
between the garden owner and the operator to be valid, the operator must not
have a partnership in the garden. In a fasid musakat contract, it is not
necessary to pay equivalent wages for the partner's labor, just like in a fasid
leasing contract.
