AMERİKA BİRLEŞİK DEVLETLERİ’NDE MİLLİ PARK SİSTEMİNİN GELİŞİMİ VE TÜRK HUKUKUNA ETKİSİ

Özet

Bu çalışma, Amerika Birleşik Devletleri’nde millî parkların doğuşunu, millî park teşkilatının kurumsallaşma sürecini, koruma ve işletmeye ilişkin yasal düzenlemeleri incelemeyi ve bu gelişmelerin Türk hukukuna yansımalarını değerlendirmeyi amaçlamaktadır. Türkiye’de millî parklara ilişkin anayasal normlar ve ilkeler ABD’den farklı olmasına rağmen, işletmeye dair ABD hukukundaki düzenlemeler neredeyse olduğu gibi iktibas edilmiştir. Bu iktibasın bir sonucu olarak, millî parkların rekreasyon amacıyla özel kişilerce işletilmesi usulü yaygınlaşmıştır. Bu durum, millî parklarda koruma-kullanma dengesini kullanım lehine kaydırmış; iktisadi kaygıları, millî parkların yönetiminde belirleyici bir unsur haline getirmiştir. Oysaki millî parklarda doğal manzaranın ve yaban hayatının mümkün olduğunca aynen korunması ve sürdürülmesi; rekreasyonel kullanımın ise doğaya zarar vermeyecek ve alan üzerinde en az etki yaratacak biçimde yürütülmesi temel prensiptir. Bu kapsamda yasalarda kullanıma ağırlık veren hükümler ile millî parkların işlettirilmesini öngören düzenlemelerin Anayasaya uygunluğu tartışılacaktır.
This study aims to examine the emergence of national parks in the United States, the institutionalization process of the national park administration, and the legal regulations concerning conservation and operation, and to evaluate the reflections of these developments on Turkish law. Although the constitutional norms and principles governing national parks in Turkey differ from those in the United States, the regulations concerning operation under U.S. law have been almost entirely adopted. As a result of this transposition, the practice of operating national parks for recreational purposes by private entities has become widespread. This development has shifted the conservation-use balance in favor of use and has positioned economic considerations as a determining factor in the management of national parks. However, the fundamental principle governing national parks is the preservation and continuation of natural scenery and wildlife as far as possible in their original state, and the conduct of recreational use in a manner that does not harm nature and creates minimal impact on the area. In this context, the constitutionality of legal provisions prioritizing use and authorizing the operation of national parks by private entities will be examined.
